Welcome to CyberCoach. By downloading, accessing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By creating an account or using CyberCoach, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
CyberCoach is a fitness application that provides AI-generated workout plans, exercise demonstrations, progress tracking, and coaching features. The App also offers tools for personal trainers to manage clients, create custom programs, and communicate with their clients.
3. Eligibility
You must be at least 18 years old to use CyberCoach. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
You may be required to create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
5. Subscriptions and Payments
CyberCoach offers subscription-based access to premium features. Subscriptions are billed through Apple's App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription through your Apple ID account settings.
- Refunds are handled by Apple according to their refund policies.
- Free trial periods, if offered, convert to paid subscriptions unless canceled before the trial ends.
6. Health and Fitness Disclaimer
Important: CyberCoach is not a medical service and does not provide medical advice. The workout plans, nutrition information, and coaching provided through the App are for general fitness purposes only. Always consult with a qualified healthcare provider before starting any exercise program, especially if you have any medical conditions, injuries, or concerns. You use the App and follow its recommendations at your own risk.
7. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to any part of the App
- Interfere with or disrupt the App's functionality
- Share your account credentials with others
- Use the App to harass, abuse, or harm others
- Upload or transmit malicious code or content
8. Trainer Services
Personal trainers who use CyberCoach to manage clients are solely responsible for the advice, programs, and services they provide to their clients. CyberCoach is a platform that facilitates communication and program delivery but does not employ trainers or guarantee the quality of their services.
9. Intellectual Property
All content in the App, including but not limited to text, graphics, logos, videos, exercise demonstrations, and software, is the property of CyberCoach or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
10. Limitation of Liability
To the maximum extent permitted by law, CyberCoach and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of profits, arising from your use of the App.
11. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
12. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the App settings.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or by other means. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
